Making Belgian intellectual property case law available
The Federal Public Service Economy now provides the public with a free, online database compiling judicial decisions issued in Belgium in the field of intellectual property (copyright, patents, trademarks, etc.).
This initiative aims to enhance transparency, understanding, and accessibility of the applicable law in areas such as copyright, patents, trademarks, designs, plant variety rights, and other specific intellectual property protection regimes.
The database, which will be regularly updated, groups decisions by year and by topic. These decisions are issued by Belgian courts and have been transmitted to the Belgian Intellectual Property Office. It allows professionals, researchers, students, and citizens to consult rulings that shape the interpretation and application of intellectual property law in Belgium by the courts and tribunals.
The database will be gradually updated as decisions are processed.

What is intellectual property case law?
Case law refers to the body of decisions rendered by Belgian courts in concrete cases. In the field of intellectual property, it concerns judicial decisions issued in disputes relating to copyright, patents, trademarks, designs, etc. It helps clarify sometimes complex legal concepts (such as the originality of a work, the applicable sanctions in cases of infringement, or the validity criteria of a filing) and to specify their application.
